The High Court has stayed the lease notice for setting up a cattle market in Aftabnagar in the capital for the holy Eid-ul-Azha. Lawyers said this means no cattle market can be held in Aftabnagar for the Eid of sacrifice.

The court also issued a rule asking why setting up a cattle market in the Aftabnagar residential area should not be declared illegal.

A bench of Justice Naima Haider and Justice Kazi Zinat Hoque passed the order, with the rule, on Wednesday, 8 May, after a preliminary hearing on a writ petition on the matter.

Senior Advocate Shah Monjurul Hoque and Advocate SM Shamim Hossain appeared for the writ petition. Deputy Attorney General Amit Dasgupta represented the state.

On 4 April, the chief estate officer of Dhaka South City Corporation (DSCC) issued a lease notice for setting up cattle markets for Eid-ul-Azha 2024. The writ was filed challenging that notice.

The local government secretary, Dhaka South City Corporation and the chief land officer of Dhaka South City were among the nine respondents named in the writ.

The writ challenging the decision to set up a cattle market in Aftabnagar was filed by Mohammad Alamgir Hossain Dhali, a resident of the area. After hearing it, the court issued its order on the cattle market on the grounds that Aftabnagar is a residential area.

Under section 3(2) and the first schedule of the Local Government (City Corporation) Act 2009, Aftabnagar (Eastern Housing) falls under Ward 37 of Badda police station, which is part of Dhaka North City Corporation (DNCC).

Separately, lawyer Md Yunus Ali Akand told Jago News that the same High Court bench had dropped from its cause list a separate writ he had filed over the cattle market in Aftabnagar.
