With Eid-ul-Azha approaching, the capital's Gabtoli cattle market will remain this year under film producer and actor Monowar Hossain, alias Dipjol.
A four-member Appellate Division bench led by senior justice M Enayetur Rahim issued the order on Sunday (26 May).
Senior Supreme Court lawyer Advocate Zainul Abedin said the work order had been issued in Dipjol's favour and he had paid the full lease money. So for now the cattle market is Dipjol's.
Chamber judge's order upheld
He said the full bench of the Appellate Division heard the writ and said the chamber judge's order would stand. The Appellate Division also fixed a bench for a later hearing. As a result, the Gabtoli cattle market will stay under Dipjol for this year's Eid-ul-Azha.
Advocate Zainul Abedin said Dipjol came first in the tender. The person in second place then filed a writ petition, and when it was brought to the court's notice an eight-week stay order was first issued.
Following that, the person in second place applied again. A hearing had been due last Sunday, but it was held today after the writ petitioner's lawyer asked for time.
How the lease dispute began
On 2 February the estate department of Dhaka North City Corporation (DNCC) invited bids to lease the Gabtoli cattle market for the Bengali year 1431. Of the two people who took part in the tender, Dipjol offered the highest lease price, Tk 17 crore 12 lakh 15 thousand. The previous lessee, Lutfor Rahman, bid Tk 16 crore 20 lakh.
On 4 April, Lutfor Rahman, the second-highest bidder, applied to the DNCC mayor and chief estate officer Mahe Alam to lease the market. In his application he said he was willing to pay Dipjol's highest bid to take the lease, but he received no response from the corporation.
Lutfor Rahman then filed a writ in the High Court over the lease of the market, and the court disposed of the writ on 23 April.
The writ petitioner said that on 30 April he went to the city corporation with an application, a copy of the court order and a bank pay order for the market. None of the offices, neither the mayor, the chief executive officer nor the chief estate officer, responded to his application.
