The High Court has stayed the setting up of a temporary cattle market at Aftabnagar in the capital for Eid-ul-Azha.

A bench of Justice Kazi Zinat Hoque and Justice Ainun Nahar Siddiqua issued the order, along with a rule, on Sunday (4 May) after hearing a writ petition filed by a lawyer.

The petitioner, lawyer Md Yunus Ali Akand, argued the application in court.

Separately, on 28 April the High Court ordered that no cattle market may be set up at Meradia in the capital for Eid-ul-Azha. That order was issued by the same bench of Justice Kazi Zinat Hoque and Justice Ainun Nahar Siddiqua after a hearing.

Today the High Court stayed for three months the relevant part of a lease notice for setting up a cattle market at Aftabnagar ahead of the coming Eid-ul-Azha.

Tenders for temporary cattle markets were invited on 21 April through a lease notice signed by the chief estate officer of Dhaka South City Corporation (DSCC). Column 5 of the notice listed the 'vacant land of Aftabnagar (Eastern Housing) Block E, F, G, H, Section 1 and 2' for lease as a temporary sacrificial animal market.

The notice said the market would run for five days, including Eid day. Lawyer Yunus Ali Akand filed the writ on Wednesday (30 April) challenging the legality of column 5 of the notice, and argued it himself. Deputy Attorney General Badiuzzaman Tapadar and Assistant Attorney General J R Khan Robin represented the state.

Yunus Ali Akand said the High Court had stayed for three months the part of the lease notice concerning the vacant land of Aftabnagar (Eastern Housing) Block E, F, G, H, Section 1 and 2.

He told Jago News that the rule asks why column 5 of article 14 of the lease notice issued on 21 April should not be declared beyond lawful authority. The respondents, including the local government secretary, the administrator of Dhaka South City Corporation and the chief estate officer, have been asked to reply to the rule within four weeks.
